Hi

new instance install is throwing the error above, tried to two new sites with a user with full admin control.

Any ideas please?

Could you uninstall HelpDesk and install it again?

But before, make sure that the account you use to install HelpDesk have access to the root site and have proper permission level to install HelpDesk. The most sure way to install HelpDesk is to create a site collection or subsite with some account, set it as an owner and then install HelpDesk on that site/subsite with the same account.
